These terms govern your use of the ZELVIVO website and any purchase you make from it. By browsing the site or placing an order you agree to them. Please read them before you buy.

1. Who we are

This site is operated by Mason Hill, trading as ZELVIVO, based in Texas, United States. Throughout these terms, "we", "us" and "our" mean Mason Hill trading as ZELVIVO. "You" means the person browsing the site or placing an order.

You can reach us at hello@zelvivo.com. Every question comes to us by email, and we answer each one ourselves.

2. Using this site

You may use this site to browse our products and to place orders for your own use. You must be at least 18, or old enough to enter a binding contract where you live, and you must give accurate information when you order.

You may not use the site to break any law, to interfere with how it works, to scrape or copy it at scale, or to attempt to gain access to any part of it that is not intended for you. We may suspend or refuse service to anyone who does.

3. Products, images and descriptions

We describe our products as accurately as we can, and the specifications listed on each product page are the ones we stand behind.

Two honest caveats about how things look.

Photography is illustrative. Lifestyle images show a product styled in a room to give you a sense of scale, material and use. Props, plants, food and furniture in those images are not included. What you receive is the product described in the title and specifications.

Natural materials vary. Seagrass, rattan, bamboo, acacia, stoneware and hand finished ceramics are not manufactured to a uniform appearance. Tone, grain, weave tension and glaze differ from piece to piece, and hand woven and hand thrown items are never identical. This variation is a property of the material rather than a defect, and it is not on its own grounds for return as faulty. If you would rather not have variation, our glass and plastic ranges are consistent piece to piece.

Screens also render colour differently. We cannot guarantee that a colour on your display exactly matches the item in daylight.

4. Prices and errors

Prices are listed in US dollars and may change without notice. The price that applies to your order is the one shown at checkout when you place it.

We try hard to get pricing right, but if a product is listed at an obviously incorrect price because of a typographical or system error, we are not obliged to sell at that price. If this happens after you have ordered, we will contact you, and you can either confirm the order at the correct price or cancel it for a full refund.

Unless stated otherwise, prices exclude shipping and applicable sales tax, which are calculated at checkout.

5. Orders

Your order is an offer to buy. We accept it when we send you a confirmation that the order has been dispatched, and a contract forms at that point.

We may refuse or cancel an order, including after you have received an order confirmation email, where:

• the item is unavailable
• there was a pricing or description error
• we suspect fraud or an unauthorised transaction
• we cannot ship to the address given
• the order appears to be for resale rather than personal use

If we cancel an order you have paid for, you receive a full refund. That is the extent of our liability for a cancelled order.

6. Payment

Payment is taken at checkout through our payment providers. We do not see or store your full card details. By ordering you confirm you are authorised to use the payment method.

7. Shipping and risk

Delivery times, costs and destinations are set out in our Shipping Policy, which forms part of these terms.

Risk in the goods passes to you on delivery. Ownership passes once we have received payment in full.

8. Returns

Your return and refund rights are set out in our Refund and Returns Policy, which forms part of these terms. Nothing in these terms removes any statutory right you have as a consumer that cannot lawfully be excluded.

9. Intellectual property

The content on this site, including text, product descriptions, photography, graphics and the ZELVIVO name and marks, belongs to us or our licensors. You may not copy, republish or use it commercially without our written permission. You may of course share links, and you may keep a copy of your own order details.

10. Reviews and anything you submit

If you send us a review, photograph, comment or suggestion, you give us a non exclusive, royalty free licence to use it in connection with our business, including on our site and in marketing. You confirm it is your own work, that it is truthful, and that it does not infringe anyone else's rights or contain anything unlawful. We may edit for length or remove anything at our discretion.

11. Third party links

Our site may link to sites we do not control. We are not responsible for their content, their policies or anything you do there.

12. Disclaimers

We provide the site and our products with reasonable care and skill. Beyond that, and to the fullest extent the law allows, we do not give warranties that the site will be uninterrupted or error free, or that any product will meet a purpose you have not told us about.

Our products are household storage, kitchen and homeware items intended for ordinary domestic use. Use them as described. Some carry specific safety instructions, for example anti tip fixings on freestanding furniture, stated weight limits, and the requirement to let adhesive fittings cure for 24 hours before loading. Follow them. We are not responsible for damage or injury caused by use contrary to the instructions supplied.

13. Limitation of liability

To the fullest extent permitted by law, our total liability to you arising out of or in connection with an order is limited to the amount you paid for that order.

We are not liable for indirect or consequential loss, including loss of profit, loss of use, or damage to other property, except where such loss results from our negligence causing death or personal injury, from fraud, or from any other liability that cannot lawfully be limited.

Nothing here limits your statutory rights as a consumer.

14. Indemnity

You agree to indemnify us against any claim arising from your breach of these terms or your misuse of the site.

15. Governing law and disputes

These terms are governed by the laws of the State of Texas, United States, without regard to its conflict of laws rules. The state and federal courts located in Texas have jurisdiction over any dispute.

Before starting formal proceedings, please email hello@zelvivo.com. Most problems are solved faster in an email than anywhere else, and we would rather fix something than argue about it.

16. Changes

We may update these terms. The version that applies to your order is the one published when you placed it. The last updated date at the top tells you when this version took effect.

17. If part of this is unenforceable

If any provision of these terms is found unenforceable, the rest continues to apply.
